Terms and Conditions of Sale
1. Purpose
These Terms and Conditions of Sale ("Terms") govern the purchase of subscription-based services provided through the application RougeFish (the "Service").
2. Service Provider
The Service is developed and operated by Kevin DJANI (the "Publisher").
The Publisher is responsible for the content, functionality, and operation of the Service.
3. Merchant of Record
All purchases are processed by LemonSqueezy, acting as Merchant of Record.
As Merchant of Record, LemonSqueezy is the legal seller of the subscriptions and is responsible for payment processing, invoicing, tax calculation and collection, and refunds.
By completing a purchase, the customer enters into a contractual relationship with LemonSqueezy for the payment aspects, and with the Publisher for access to and use of the Service.
4. Subscriptions
The Service is offered exclusively through subscription plans. Each subscription grants access to specific features for the duration of the active subscription period.
Subscription details, pricing, and included features are presented at the time of purchase.
5. Pricing
Prices are displayed in the currency indicated at checkout and may include applicable taxes, depending on the customer's location.
LemonSqueezy determines and applies applicable taxes in accordance with local regulations.
6. Payment
Payments are processed securely by LemonSqueezy using the payment methods made available at checkout.
The Publisher does not store or process any payment information.
7. Billing and Renewal
Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected).
Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
8. Cancellation
The customer may cancel their subscription at any time via their account dashboard or through the LemonSqueezy customer portal.
Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time unless otherwise required by applicable law.
9. Refund Policy
Refund requests are handled by LemonSqueezy in accordance with its refund policy.
Any approved refund will be processed by LemonSqueezy using the original payment method.
10. Access to the Service
Access to the Service is granted for the duration of an active and paid subscription.
The Publisher reserves the right to suspend or terminate access in case of violation of these Terms or misuse of the Service.
11. Intellectual Property
All intellectual property rights related to the Service, including software, content, and trademarks, remain the exclusive property of the Publisher.
No rights are transferred to the customer other than the right to use the Service during the active subscription period.
12. Liability
The Service is provided "as is" without warranty of any kind.
To the maximum extent permitted by law, the Publisher shall not be liable for indirect or consequential damages arising from the use of the Service.
13. Governing Law
These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Marseille, unless otherwise required by mandatory law.
